Notary in Spain

The work carried out by a notary

A notary works at a higher level of legal administration than either a gestor or an abogado.

A notary is directly authorised by the state to legally oversee public documents and declare by law that the property purchase is legal.

The notary will examine the paperwork of the purchase which the gestor has compiled, and attributes the taxes and registration of the property.

On the day of purchase, they will read through and explain the documents to the interested parties and witness the signature of both parties.
These documents are then allowed for public viewing, as authorised by the state.

Another important function is that the notary collects the taxes due on the transaction and retains them for the government.

We work very closely with our gestor from our office in Formentera, who in turn works closely with the notary to ensure that the administration of your property sale or purchase is secure and legal.
